1. General provisions

This policy document applies to all communications and transactions sent from, through or to the equipment associated with this domain name.  This website and all related equipment is administered by LUXITUDE INCORPORATED, Inc.  (hereinafter 'Luxitude' or 'LUXITUDE.NET') as governed by the consituting articles of janyary 1st, 2007 (“CA”) including any and all amendments made up until november 30th, 2025.  The use of this website and related computational services is subject to the conditions and restrictions below within the framework of LACNIC and RIPE exchange notification framework.

2. Software and Definitions

The software (including boot code, embedded software, remote software, downloaded application or parts thereof and any third party software), documentation, interfaces, content, fonts, and data included with your device ("Original Luxitude Software") or Service (“Original Luxitude Service”), as may be updated or replaced with enhanced functionality, software updates, security measures, system files or system recovery software provided by Luxitude for your Device, Supported Peripheral or Service ("Luxitude Software Modifications"), whether in read-only memory, on any media, in transit or in any other form (the Original Luxitude Software and the Luxitude  Software Modifications collectively referred to as the "Luxitude Software"), are licensed, not sold, to you by Luxitude Inc. ("Luxitude") only for use under the terms of this License. Luxitude and Luxitude's licensors retain ownership of the Luxitude Software and reserve all rights not expressly granted to you. You agree that the terms of this License will apply to any Luxitude application that may be embedded in your device or service, unless such application includes a separate license, in which case you agree that the terms of that separate license will govern your use of the application.

3. Inquiries

Other languages might be acceptable but any and all costs for official translations shall be covered by the requesting entity only.

4. Website

By using this website (hereinafter the 'WEBSITE') or it's servers (heeinafter the 'SERVERS') or it's communication infrastucture (herinafter 'COMS') such as, but not limited to e-mail or RFC822 related messaging systems and other systems terminated at or originating from these servers over UDP/TCP connections, on premise equipment (OPE) or colocated (COLO) the user accessing and/or consuming any services  provided has to comply to the General Terms and Conditions (GTC) as indicated in this document. For further reading please refer to “http://luxitude.net/algemenevoorwaarden”. As a result of historical events within the limitations set forth in article 4 of the constituting articles, we hereby inform you that our servers and adminstrative departments are shared between the European and OEA territories and all services provided as best effort and/or limited to 25GB per month maximum.

5. Artificial Intelligence and AI Assisted Production and Development Systems

5a. No part of this production and/or file and/or any prerequisite and/or dependency to this production and/or file and/or software may be used or reproduced in any manner for the purpose of training artificial intelligence technologies or systems on any and all continents. Any derivative work shall include the document reference code "71f2f336-fb6b-11ef-9304-4237cc197fb2"  no later that march 24th, 2025. Not complying with this part of the GTC is considered a material breach of copyright on original work product.

5b. You acknowledge and agree that you may not, and will not enable others to, copy (except as expressly permitted under this License), decompile, reverse engineer, disassemble, decrypt, adapt, attempt to derive the source code of, or create derivative works of, the Luxitude Software or any services provided by the Apple Software, or any portion thereof (except as and solely to the extent any foregoing restrictions are prohibited by applicable law or as permitted by the license terms governing the use of the Open Source Components that may be included with the Apple Software). You agree not to remove, obscure or alter any proprietary notices (including trademark and copyright notices) that may be contained in or included with the Luxitude Software.

6. Processing of data

This policy covers any and all operations and/or technical procedures, automated, semi-automated or manual, that permits compiling, registration, organization, storage, conservation, preparation, modification, extraction, consultation, utilisation, blockage, suppression, communication by transfer or distribution or any other form of processing that facilitates the access, correlation or interconnection of personal data processed through, on or using the WEBSITE, SERVERS or COMS in a variety of jurisdictions. Technical measures are in place to diversify service levels and accessible content depending on authorization clearance for a variation of purposes. For IVA reasons and currency exchange in the consumer market we keep a proportionate reservation for documents in the physical format and digital safeguards.

7. Liability

Luxitude, it’s shareholders, representatives and board of directors cannot be held liable for the content of the information on the website or for the consequences of use of it’s COMS and COLO.  No rights can be derived from the information displayed on the website.  No guarantees can be given that the website will operate error-free and uninterrupted for the general public The Luxitude is not responsible for the content of third party websites to which the website is linked. Amendments and exceptions can be made upon proper authorization of the individuals. Records will be kept for a period of 6 months minimum. Any and all legal or informal actions based on any and all information contained in any and all messages distributed through the COMS, COLO are strictly the responsibility of the user of the information. Luxitude does not approve, condone or assert responsibility unless explicitly  confirmed through the verfification channels provided.

8. Copyright 

Information displayed on the website, including, but not limited to, texts, photographs, illustrations, graphics, (business) names, logos, product and service marks are owned by or licensed to the Luxitude or affiliated institutions and are protected by copyright, trademark rights and/or any other intellectual property right.  The (intellectual) property rights are not transferred in any way to legal or natural persons who gain access to the website. Material submitted by website visitors in the form of any and all regulated messaging services, emails, photographs, feedback forms or other responses can be used by the Luxitude or affiliated institutions to improve or adapt the website . The website user is prohibited from reproducing, changing, removing, forwarding, distributing, circulating, or making available in return for payment to third parties any part of the content of the website without the explicit, written approval of the Luxitude or one of the affiliated institutions.

9. Confidentiality

All emails refering to this disclaimer directly or indirectly using the COMS or COLO defined above and any files transmitted with it are confidential and intended solely for the use and exchange of the individual or entity to whom they are addressed.  If you have receive an e-mail in error, please notify the system manager at admin@luxitude.net and return the message swiftly while making sure you remove all copies on premise and enforce for removal of any and all related messages in transit.  Messages contains confidential information and is intended only for the individual named in signed and recorded fields.  If you are not the named addressee you should not disseminate, distribute or copy such messages.  Failure to comply may result in procedures for copyright infringment and may be forbidden by law as a result of containing medical information. Please notify the sender immediately by e-mail if you have received this e-mail by mistake and delete this e-mail from your system.  If you are not the intended recipient you are notified that disclosing, copying, distributing or taking any action in reliance on the contents of this information is strictly prohibited. Not complying with this policy disclaimer may result in liability for consequential, incidental, indirect, actual or compensatory, direct or general, specific, punitive, and exemplary damages.

10. Records keeping 

Transmission and reception of all e-mail and web service requests within the standard defined as per january 2006 with amendments processed through our servers is recorded and stored for a minumum of 1 year.  The availability of each transmission record can be checked through the URL indicated in the X-Mail-Record and X-Web-Record headers.  You are advised to check the authenticity of each message you receive and sent.  In the case of differing views on the origin, contents or delivery of messages sent by e-mail or transfeed through the http and https assigned port numbers from any and all servers referenced in the fi.luxitude.net.  domain name services zone accessible from the INFRA connected through IPv4 address 136.144.237.10, the X-Mail-Record and X-Web-Record headers provide official proof.  The X-Mail-Record database records are kept for a minimum of 3 years. The sequencing numbers contained in the transactional record are mandatory parts for message integrity screening. You are advised that any and all e-mail handling tools like virusscanners and the like might interfere with these headers and therefore, depending on the importance of the messages being sent or received, check the message integrity through the webmail and make a certified print using the webmail panel print button. If for any reason you require a certified copy of past messages these can be requested through enquiry@luxitude.net and depening on the nature of your request, Luxitude is allowed to charge you for the costs of lookup, archival, recovery and handling of such requests.
